Contractors at all tiers are required to have a certain percentage of their journeymen be graduates of state-approved apprenticeship programs. Therefore, it is imperative to closely monitor the prime contractor on your project, and all subcontractors as well.
The newest proposed legislation, AB 3018 imposes various penalties on contractors including, but not limited to, the following:
- Monthly civil penalties, up to $10,000
- Withholding 150% of the value of monthly billing
These new penalties are not only enforceable on future contracts, but (the jury is still out) may affect those entered into before January 1, 2019.
